The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with Biaggio Markt SRL, hereinafter referred to as “BIAGGIO”, ”us ” or ”we”, at the BIAGGIO desktop website and mobile website. By using and/or placing an order at biaggio.online, you agree to be bound by the terms and conditions set out herein (the ”Terms & Conditions”). Please make sure you have read and understood the Terms & Conditions before placing your order.

Only persons of legal age, 18 years or older, who are not under guardianship, can place an order at biaggio.online

The inclusion of any products or services on biaggio.online at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time. We reserve the right to amend these Terms & Conditions from time to time without prior notice to you. The version of the Terms & Conditions that will apply to your order will be those on biaggio.online at the time you place your order.

BIAGGIO want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the biaggio.online site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these Terms and Conditions.

Prices and delivery charges

From time to time, prices are subject to change in response to currency exchange rate changes, markdowns and other commercial factors. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of re-confirming your order at the correct price or cancelling it.

We currently ship DDP (Delivery Duty Paid) to the European Union. As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to and payment of these is necessary to release your order from customs on arrival.

The delivery charge for each order will be the same, regardless of the size or weight of your order. The cost for each delivery method is clearly indicated during the check-out process. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries. Prices in store and online may vary.

Ordering/conclusion of contract

The ordering options available are solely via biaggio.online.

Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfil your order, we will let you know at our earliest convenience. If we have already received payment for such order, we will refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you via email to settle the refund.

Delivery

BIAGGIO exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order in accordance with your selected delivery option.

BIAGGIO endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. We work closely with our shipping partner to minimize the potential impact of custom delays on our international customers.

Before you place your order, you will be informed of the expected delivery timelines. Once you have placed your order, you will receive an email confirmation with your order details. When your order is dispatched from our warehouse, you will receive an email with tracking information that will show estimated delivery dates. If your order does not arrive by the scheduled date, please contact BIAGGIO Customer Service within 30 days, from the date the order was placed, via email or our contact form, which can be found at biaggio.online. After this period of time, we are not able to claim any lost orders.

Withdrawal of order

Once an order has been successfully placed, BIAGGIO can not issue changes or cancellations on this order. Once you have received your unwanted order, please return this back to our warehouse in accordance with section 5 (Returns) for a full refund.

Returns

You have the right to return your order for any reason from the date you receive your order until 30 days post receival date. If you have been charged for the items, you will receive a refund once package is received at our warehouse, which will include the standard delivery cost.

Should you choose to keep certain items and only partially return your order, the delivery cost will not be refunded. If you wish to return your order, please use the pre-printed return form in your parcel, and return the item(s) to us as set out. Drop off your items to be returned at the UPS access point of your choice*

*Please note that BIAGGIO cannot accept returns that have not been sent with our pre-printed return label. If you have sent your order for return with your own choice of carrier, we will not receive the parcel to our warehouse nor be able to give you a refund on your order. Please also note that BIAGGIO will not be responsible for any shipping cost or lost packages when the order has not been sent with the above mentioned pre-printed label.

We guarantee a refund for any returned products, provided that all products are returned in their original condition and in their original packaging. This means the products should not have been damaged, soiled, washed, altered, or worn (you may try products on indoors and shoes must be tried on a carpeted surface). All original tags and labels must be attached and any additional items included in the packaging must be sent back in their original condition – this includes but is not limited to BIAGGIO boxes, instructions, stickers, accessories, labels, and protective covers. Please note that returned items that do not meet these conditions will not be accepted and will be sent back to you.

To be certain that we offer free returns in your country, please visit our FAQ. We will provide a refund attempting to use the same method used to make the payment (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 14 days of receiving your returned goods to our warehouse. If the item you have received is defective, please notify BIAGGIO promptly and return the item in the same way as stated above. BIAGGIO will, for any products deemed defective, provide a full refund, including the costs of delivery and return.

The provisions set forth herein do not limit any applicable statutory rights In the event of an error in connection with any products or services displayed through biaggio.online (including typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability), BIAGGIO reserves the right to cancel any order prior to the time it is delivered to you.

Payment

Credit & debit card

We accept Visa, MasterCard, American Express, Maestro and JCB cards, and any other methods which may be clearly advertised on the Site from time to time. The applicable amount will immediately be charged on your credit/payment card. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to BIAGGIO, we will not be liable for any delay or non-delivery.

Other

You are obliged to submit a correct email address and to inform BIAGGIO if your email address changes. Please note that BIAGGIO reserves the right to send payment requests to your email address. You will receive the legally required invoice in the shipping confirmation email.

Our Liability

Nothing in these Terms & Condition shall exclude or limit BIAGGIO’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms & Conditions, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach. BIAGGIO is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms & Conditions where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order on biaggio.online shall be limited to the total price of your order.

Guarantee

If there are defects in the goods you have purchased, BIAGGIO abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form.
